REPORTS TO THE JAPAN MEDICAL SAFETY RESEARCH ORGANIZATION AND AVOIDING MEDICAL LAWSUITS

Under legislation introduced by the Ministry of Health, Labour and Welfare, it is mandatory to report “unexpected patient deaths due to medical care” to the Japan Medical Safety Research Organization. Approximately one-third of the total reports made involve general surgery, cardiovascular surgery, and other procedures performed by members of the Japan Surgical Society. Surgery is therefore considered a high-risk treatment from the viewpoint of the medical accident investigation system. In some cases, medical lawsuits were filed simultaneously with the reports, although the number has not been disclosed. To avoid and respond to medical lawsuits, it is crucial to prevent accidents as well as deal with any that may occur. In addition, in-hospital investigations including pathological autopsy after accidents and strict observance of medical safety protocols in the operating room are necessary.
